He died intestate and his widow was made administrator of Atherton Thayer, gentleman, deceased, and bonded with Ebenezer Thayer, gentleman, of Braintree, and Jacob Thayer of Boston, housewright. She was also made guardian of Ruth and Rachel, under 14, children of Atherton Thayer.

Ebenezer Thayer sold his son Atherton Thayer the west half of his dwelling house May 21,1756 (S.D. 96-144) and on May 20,1765 the same half was sold by execution by Ebenezer Thayer Jr. "and widow Ruth Thayer hath since inter married with Ebenezer Penniman." (S.D. 105-74).

He was a mechanic, cordwainer, and laborer, resided on Main St., near Oak St., Randolph, had seventeen children. He was a boot cutter in 1850 census.

He resided in East Randolph (now Holbrook).

His estate was distributed to his children Timothy eldest son, Levi, a son, Elizabeth Thayer a daughter.

His widow Bethiah (Thayer) Thayer left a will mentioning her nephews Robert and Bethuel Thayer who were grand children of her husband by his first wife. The Thayer Memorial (1835) says Benjamin Thayer had fifteen children, all but three of whom died young.
Bethiah wife of Benjamin Thayer joined the Randolph Church in 1795.
He removed to the So. Precinct (Holbrook) about 1752 where the children were baptized after that time.

Benjamin Thayer 2nd was elected hogreave 1749, constable 1765 but excused.

He was elected constable 1746,1748,1749, surveyor of highways 1756, surveyor of lumber 1758,61,62,65, to 1772, culler of staves 1759,1765-71, & 1775, sealer of shingles 1766-1771. He was a boatman, resided in East Braintree on Commercial St., near Mill St. where the Vintons had property. No settlement of his estate is in probate records.

Margaret Thayer, widow was administrator of Benjamin Thayer, husbandman Dec.26,1712. The inventory included a house & barn, 6 acres, out lands, also a nursery and trees set out. Richard Thayer, blacksmith, was made guardian to Benjamin Thayer aged about 16, May 25,1724, and Moses Curtis, innholder, of Dorchester (now Avon) was made guardian of Zebulon Thayer Jun.5,17-(24?).
