Widow Elizabeth administered the estate May 27,1746. He left a will dated Mar.14,1744, proved May 27,1746, saying, "Whereas I am impressed into his Majesties service in an intended expedition against Cape Breton" and mentions wife Elizabeth and four sons Nathaniel, Benjamin, Simeon and Phineas who are to have the real estate and pay the three daughters £6 each, to Mary, Elizabeth and Phebe, after youngest son Phineas is aged 14.

Benjamin Payne is mentioned in the records in 1730 but apparently held no office. Resided on part of his father's land in So. Precinct on present Center St. Holbrook, near Mill St., where his great grandson Silas Payne now (1857) lives, says Dr. Alden.

S.P.39-42 - Will of Benjamin Payne, Mar.14,1744 - May 27,1746:
To wife Elizabeth & sons Nathaniel, Benjamin, Simeon, & Phineas, dau. Mary, Elizabeth & Phebe.
Wife Mary & Thos. Waills executor.
Wit: Moses Curtis Jr, Ebenezer Spear, Elhanan Lyon.
